Episode 4x09 - Ben on Set in Tunisia

Yesterday we posted some more set pics of LOST Episode 4x09 and in one of the images you can clearly see Michael Emerson as Ben (supposedly it was his stand-in) on the set being filmed while taking a picture of something.

Now behind him off-camera it looks like Frank Lapidus (Jeff Fahey)!? Is this possible or is it well known LOST Director Jack Bender who is also known to wear similar attire as Lapidus' character. Is this a major LOST spoiler!? Or just a case of mistaken identity!?
